Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you ("you" or "User") and SC Digital Solutions ("we", "us", "our"), operator of the website scdigitalsolutions.net and the products marketed under the brand "ScamShield" / "The Anti-Scam Playbook" (collectively, the "Services"). By accessing the website, creating an account, or purchasing any product, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a legally binding contract. The Services are not directed to children under 13 (or under 16 in the EEA/UK).

2. Description of the Services

  • Digital downloads — PDF guides such as "The Anti-Scam Playbook", "SafeCall Family Code-Word Kit" and "The Art of the AI Second Opinion".
  • ScamShield Premium (SaaS) — an AI-assisted tool that analyzes user-submitted text, emails, and links to estimate scam risk, plus a community database of reported items and family alerts.
  • The Services are informational tools only and are not legal, financial, medical, investigative, or law-enforcement advice. See our Disclaimer.

3. Accounts and security

  • You are responsible for safeguarding your credentials and for all activity under your account.
  • You must provide accurate information and keep it up to date.
  • We may suspend or terminate accounts that violate these Terms or applicable law.

4. Subscriptions, billing and auto-renewal

  • Premium is billed on a recurring basis (monthly) at the price displayed at checkout, processed by our payment partner Shopify and underlying card networks. Prices include applicable VAT/sales tax where required.
  • Auto-renewal: subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account or by contacting support@scdigitalsolutions.net; cancellation takes effect at the end of the current paid period.
  • US residents — auto-renewal disclosure (CA Bus. & Prof. Code §17600 et seq. and similar state laws): by purchasing a subscription you authorize us (through our payment processor) to charge your payment method on a recurring basis. You will receive an email acknowledgement of the subscription. You can cancel any time as described above.
  • Failed payments may result in suspension of Premium features until payment is updated.

5. Refunds and right of withdrawal

Our refund terms are set out in the Refund Policy, which is incorporated into these Terms.

6. License to digital content

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the digital products for your personal, non-commercial use within your household. You may not: (a) resell, sublicense, or redistribute the materials; (b) post them publicly; (c) use them to train machine-learning models; (d) remove proprietary notices; or (e) use them in any way that competes with the Services.

7. Acceptable use

You agree not to: (a) use the Services for any unlawful purpose or to violate any law (including export controls and U.S. OFAC sanctions); (b) submit content that is unlawful, defamatory, or that infringes third-party rights; (c) attempt to interfere with, reverse-engineer, or scrape the Services; (d) use the Services to harass any person; (e) bypass usage limits or rate limits; (f) submit personal data of others without lawful basis.

8. User-submitted content and AI output

  • You retain ownership of the text you submit. You grant us a worldwide, royalty-free license to process it solely to provide and improve the Services.
  • AI output is generated probabilistically and may be inaccurate, incomplete, or out of date. Always exercise independent judgement and, where appropriate, consult law enforcement, your bank, or a qualified professional.
  • You must not rely on AI output as the sole basis for any decision with material legal, financial, medical, or safety consequences.

9. Intellectual property

The Services, including all text, graphics, logos, software and underlying technology, are owned by SC Digital Solutions or its licensors and are protected by copyright, trademark and other laws worldwide. All rights not expressly granted are reserved.

10. Third-party services

Checkout is processed by Shopify Inc.; authentication, hosting and database are powered by Supabase; AI inference may use third-party model providers. Their terms and privacy policies apply to the portions of the Services they provide.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. We do not guarantee that any specific scam will be detected or prevented.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions our liability is limited to the maximum extent permitted by law and your statutory consumer rights remain unaffected.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SC DIGITAL SOLUTIONS, ITS AFFILIATES, OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law (including, where applicable, the EU Consumer Sales Directive, the UK Consumer Rights Act 2015, and U.S. state consumer-protection statutes).

13. Indemnification

You agree to defend, indemnify and hold harmless SC Digital Solutions from and against any claims, damages, losses and expenses (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your misuse of the Services, or (c) your violation of any law or third-party right.

14. Governing law and jurisdiction

These Terms are governed by the laws of Italy (Republic of Italy), without regard to its conflict-of-laws principles. Subject to any mandatory consumer-protection laws that apply where you reside, the parties submit to the exclusive jurisdiction of the competent courts of Italy. Consumers in the EU may also bring proceedings in the courts of their place of residence and may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. United States customers — additional terms

  • Informal dispute resolution: before filing any claim, you agree to first contact us at support@scdigitalsolutions.net and try in good faith to resolve the dispute for at least 60 days.
  • Class-action waiver: to the extent permitted by law, claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
  • Jury trial waiver: each party waives any right to a jury trial to the extent permitted by law.
  • California, Colorado, Connecticut, Utah, Virginia and other state-privacy-law residents: see our Privacy Notice for your rights, including the right to opt out of "sale" or "sharing" of personal information. We do not sell personal information for money.
  • U.S. export controls: you represent that you are not located in, and not a national or resident of, any country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.

16. Changes to the Services and to these Terms

We may update the Services and these Terms from time to time. Material changes will be notified by email or by a prominent notice on the website at least 14 days before they take effect, except where a faster change is required by law or to address a security risk. Continued use after the effective date constitutes acceptance.

17. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnity, governing law and dispute resolution) will survive.

18. Miscellaneous

  • Entire agreement: these Terms, together with the Privacy Notice, Cookie Policy, Refund Policy and Disclaimer, constitute the entire agreement.
  • Severability: if any provision is held unenforceable, the remainder will remain in effect.
  • No waiver: failure to enforce a provision is not a waiver.
  • Assignment: you may not assign these Terms without our prior written consent; we may assign in connection with a merger, acquisition or sale of assets.
  • Force majeure: we are not liable for delay or failure caused by events beyond our reasonable control.
  • Notices: notices to us must be sent to support@scdigitalsolutions.net.
